A POSSIBILIDADE DE DECRETAR O DIVÓRCIO POST MORTEM EM ANGOLA: ANÁLISE JURÍDICA E IMPLICAÇÕES SOCIAIS

Abstract

O presente artigo examina a viabilidade jurídica de decretar o divórcio após a morte de um ou de ambos cônjuges no decurso do processo, com base na legislação angolana, comparando-a com outros ordenamentos jurídicos. O estudo destaca a falta de previsão legal no sistema jurídico angolano de decretar o divórcio post mortem, isto é, de dar continuidade do processo de divórcio após o falecimento de um dos cônjuges no decurso da acção, resultando, por conseguinte, em uma lacuna legal. A pesquisa propõe alternativas e sugere reformas no Direito de Família em Angola, destacando a necessidade de ajustes jurídicos para alinhar-se às necessidades sociais contemporâneas. Além disso, espera-se que a pesquisa seja útil para a Comissão de Reforma da Justiça e do Direito em Angola, e que seja avaliada pelos operadores do Direito, contribuindo quer para o legislador de iure constituindo, na criação de normas relativas ao Direito de Família, quer para os investigadores no ensino do Direito.
