Desheredación e indignidad: hacia una inclusión de los concubinos en el derecho sucesorio peruano

Abstract

Este artículo analiza las implicaciones legales de los concubinatos en la asignación de herencias en la legislación peruana, destacando la necesidad de reformar las causales de exclusión, como la desheredación y la indignidad, para incluir a los concubinos. El objetivo es proponer una modificación legal que garantice un marco más justo y equitativo en el contexto sucesorio. La metodología incluye un análisis comparativo entre las legislaciones de Perú, Francia, Italia, Venezuela y Bolivia, enfocándose en los derechos y deberes de los concubinos en comparación con los cónyuges. A través del estudio, se constata que la Ley 30007 otorga derechos hereditarios a los concubinos, pero no los incluye en las causales de exclusión de herencia. Al comparar con las legislaciones de otros países, se observa que Francia e Italia han abolido la desheredación, mientras que Bolivia y Venezuela mantienen esta figura, lo que refleja enfoques normativos divergentes. Se concluye que es necesaria una reforma legislativa en Perú para incluir a los concubinos en las causales de exclusión, promoviendo así un sistema sucesorio más equitativo.
