Abstract

El trabajo analiza la sentencia del Tribunal Supremo 434/2020, de 9 de septiembre, en la que se califica como delito de asesinato el ataque con resultado de muerte realizado mediante el uso de una navaja. Si bien la agresión se enmarca en el contexto de una pelea previa, el Alto Tribunal aprecia un “salto cualitativo” en la agresión realizada por el enjuiciado en el momento en que, de improvisto para la víctima, saca una navaja con la que produce la muerte de ésta. Con ocasión de este caso, se citan otras sentencias relativas también a supuestos análogos en los que la existencia de un ataque imprevisto en el curso de una contienda lleva a la apreciación de alevosía en el ataque, y, con ello, a la calificación jurídica de los hechos como asesinato, y no homicidio.
