El movimiento a favor del lenguaje jurídico claro y comprensible y su importancia para la traducción

Abstract

Para poder garantizar el derecho de toda persona a un recurso efectivo ante los tribunales nacionales competentes (DUDH, art. 8), la persona debe ser capaz de comprender tanto los hechos que se le imputan, como las consecuencias y efectos derivados de esa imputación. Debido a ello, cualquier jurista, ya sea juez, abogado, fiscal, traductor-intérprete jurado, etc. tiene la obligación de proteger este derecho, por lo que los textos legales, sean originales o traducciones, deben ser redactados en lo que se denomina lenguaje claro: un lenguaje comprensible para la ciudadanía. Nuestro estudio analiza cómo escribir en dicho lenguaje, así como el movimiento del lenguaje claro en el marco nacional e internacional, para finalizar con una exposición de la importancia del lenguaje claro en la traducción.
