Abstract

Este trabajo revisa la evolución del derecho internacional para garantizar los derechos humanos de los pueblos indígenas. Se analizan los criterios jurisprudenciales de la Corte Interamericana de Derechos Humanos que tienen efectos jurídicos obligatorios para la creación de leyes que reconozcan el respeto, goce y garantía de los derechos humanos de los pueblos originarios y en especial de las mujeres indígenas. A través de una metodología analítico-descriptiva se hace una revisión documental enmarcada de forma histórica. Esta revisión evidencia que, a pesar de los tratados internacionales y las leyes nacionales que obligan al Estado a garantizar el pleno goce y disfrute de los derechos humanos de las mujeres indígenas, aún existen vacíos en su implementación. Estos vacíos representan un pendiente en la agenda del gobierno mexicano, además de subrayar la necesidad de fortalecer los protocolos de actuación dirigidos a los operadores jurídicos y a los integrantes de las instituciones de seguridad pública y procuración de justicia.
