Amicus curiae - Caso Collen Leite e outros vs. Brasil da Corte Interamericana de Direitos Humanos

Abstract

Este trabalho é a versão integral do documento produzido pelo Núcleo de Estudos sobre a Internacionalização do Poder Punitivo (NEIPP) da Universidade Federal do Paraná na qualidade de amicus curiae ao caso Collen Leite e outros vs. Brasil, em julgamento pela Corte Interamericana de Direitos Humanos (Corte IDH). Sob a coordenação do Professor Doutor Rui Carlo Dissenha, o NEIPP, além de discutir a Lei de Anistia brasileira à luz da jurisprudência da Corte IDH, examina a resistência do Brasil ao conceito de crimes contra a humanidade e seus efeitos, a experiência de justiça de transição no país, e as reparações devidas às vítimas a partir da memória e da verdade, inclusive a partir da perspectiva de gênero. O parecer conclui com sugestões de medidas e apontamentos finais, reforçando a necessidade de reconhecimento da responsabilidade internacional do Estado brasileiro pelas violações cometidas contra Eduardo Collen Leite e Denise Peres Crispim.
