Jueces de elección popular, un débil compromiso con la verdad

Abstract

La reforma al Poder Judicial recién aprobada en septiembre de 2024 ha generado un gran debate, principalmente por la propuesta de que los jueces sean nombrados por elección popular, los argumentos a favor son el ejercicio democrático del poder y los que están en contra señalan que se pone en riesgo la independencia judicial y la imparcialidad de los jueces, lo cierto es que la principal función del juez es conocer la verdad develada por la prueba. Esta actividad cognoscitiva parece dar respuestas más claras sobre ambas posturas argumentativas.
