Abstract

La investigación busca realizar un análisis de las sentencias sobre pensiones alimenticias de la Corte Provincial de Justicia del Carchi, para determinar si se aplica adecuadamente el principio del interés superior del niño. La importancia radica en que mediante una interpretación profunda de estos fallos se podrán identificar posibles inconsistencias con la normativa nacional e internacional sobre protección de la niñez. En este sentido, se propuso un método neutrosófico multicriterio para la evaluación de las sentencias sobre alimentos de la Corte Provincial de Justicia del Carchi. Los resultados del método propuesto permiten comprender el sentido más amplio de estas sentencias, la interacción entre la búsqueda de la verdad y las ficciones jurídicas ante falta de pruebas, así como los efectos de estas decisiones en la vida real de los niños. Los resultados ayudan a nutrir los fallos con desarrollos doctrinarios actualizados y a fortalecer la aplicación del interés superior del niño.
