Abstract

Streszczenie: Analiza projektu ustawy o zmianie ustawy o gospodarce nieruchomościami oraz niektórych innych ustaw w kontekście nowych reguł dotyczących nabycia przez użytkowników wieczystych prawa własności. Projekt zmiany ustawy o gospodarce nieruchomościami stanowi kolejny etap reformy użytkowania wieczystego, który ma na celu umożliwienie nabycia prawa własności użytkownikom wieczystym gruntów wykorzystywanych na cele inne niż mieszkaniowe, w tym przedsiębiorcom z uwzględnieniem reguł odpłatności zastosowanych w ramach instytucji uwłaszczenia ex lege, ale z zachowaniem zasady swobody umów. Proponowane rozwiązanie polega na zastosowaniu mechanizmów rynkowych przy ustalaniu ceny nabycia prawa własności. Nowa zasada odpłatności została opracowana z wykorzystaniem modelu cyklicznej odpłatności przyjętego już w pierwszym etapie reformy użytkowania wieczystego. Proponowane zmiany są bez wątpienia słuszne i niezbędne, jednak zbyt wąskie. Zaproponowany projekt, mimo iż co do zasady należy ocenić pozytywnie, nie rozwiązuje ważnych problemów jak chociażby dotyczących podziałów wieczystoksięgowych ww. gruntów. Nadto nowela stanowić będzie jedynie korektę dotychczasowych przepisów. Nie wprowadza ona możliwości żądania przekształcenia bądź sprzedaży nieruchomości oddanej w użytkowanie. Nie ma przekształcenia z mocy prawa. Nie wprowadza się też administracyjnego modelu przekształcenia. Sprzedaż będzie mogła nastąpić jedynie w sytuacji, kiedy publicznoprawny właściciel zechce sprzedać prawo własności użytkownikowi wieczystemu. Powyższe jest już jednak możliwe na podstawie ustawy o gospodarce nieruchomościami. W przypadku braku woli ze strony właściciela gruntów użytkownik wieczysty pozbawiony będzie możliwości działania. Niestety zaproponowany projekt nie rozwiązuje wskazanych wyżej problemów. Należałoby rozważyć wprowadzenie zachęt dla właścicieli jak i użytkowników wieczystych, które mogłyby nakłonić obie strony do dokonania transakcji. W ramach nich można by zaproponować termin, do którego użytkownicy mogliby nabyć prawo własności na korzystniejszych warunkach niż po jego upływie. Powyższe mogłoby się sprowadzać do tego, że do pewnego momentu mogliby nabyć z możnością rozłożenia na raty, a po terminie do zapłaty dochodziłoby już tylko jednorazowo. W artykule przeanalizowano i oceniono najnowsze propozycje zmian legislacyjnych dotyczące powyższej materii. Metodą badawczą jaką zastosowano w pracy jest analiza aktów prawnych, poglądów przedstawicieli doktryny oraz orzecznictwa sądowego.Słowa kluczowe: nieruchomości, użytkowanie wieczyste, pomoc publiczna, przekształcenie, odpłatność.

Abstract: Analysis of the bill amending the Real Estate Management Act and certain other acts in the context of new rules regarding the acquisition of ownership rights by perpetual usufructuaries Draft Law on Property Management is another phase of reforms of perpetual usufruct whose purpose it to acquire the ownership right for perpetual users of lands used for purposes other than residential, including entrepreneurs considering applicant fees regulations applied as part of the institution of enfranchisement ex lege, but with preserving the rule of freedom of contracts.The proposed solution is to apply market mechanism while establishing the price of acquiring ownership right. A new applicant fee rule was designed with the use of a cycle payment model already accepted at the first phase of the reform of perpetual usufruct. Undoubtedly, these proposed changes are right and justified, however, they are too narrow. The proposed draft, though right from its assumptions, does not solve important problems like for example those regarding the land and mortgage register divisions of the above mentioned land. Apart from that, this amendment will be merely the correction of the so-far regulations. This draft does not introduce possibility to demand the transformation or property sale given to usufruct. There is no transformation by virtue of law. Also, administrative mode of transformation is not introduced. The sale can only happen in the situation when a legal owner would like to sell the ownership right to a perpetual user. However, the above is already possible pursuant to the property management act. In case there is no good will on the part of the land owner the perpetual user will be practically deprived of ability to act. Unfortunately, the proposed draft does not solve the problems mentioned above. In this article the latest proposals of legislative changes were analysed and evaluated. The research method applied for the purpose of this article is the analysis of current laws and regulations as well as selected judicial decisions.Keywords: property, perpetual usufruct, public assistance, enfranchisement, applicant fee.
