Abstract

O Acordo TRIPS, parte integral do Acordo Constitutivo da OMC, é o mais influente tratado internacional da história em matéria de propriedade intelectual. Por meio das normas do TRIPS foi possível que diversos países adotassem padrões mínimos de proteção aos ativos intangíveis de modo a criar um inédito grau de harmonização legislativa em escala global na matéria. Isso posto, para os fins do direito interno brasileiro, o TRIPS é norma que integra o ordenamento infraconstitucional, cabendo ao Superior Tribunal de Justiça a missão de uniformizar a interpretação do Acordo no âmbito do Judiciário nacional. Assim, o presente estudo busca avaliar a evolução do posicionamento do STJ a respeito do TRIPS. Trata-se de pesquisa qualitativa, quantitativa e exploratória que utiliza o método lógico-dedutivo e os procedimentos de revisão bibliográfica, coleta e catalogação dos julgados do STJ para investigar a temática. Como resultado, são tecidas considerações a respeito dos principais dados quantitativos auferidos a partir da coleta realizada bem como são identificadas e avaliadas as posições preponderantes do Tribunal Superior acerca do Acordo TRIPS ao longo do tempo.

The TRIPS Agreement, an integral part of the Agreement Establishing the WTO, is the most influent international treaty in history for the field of intellectual property. Through the rules set in TRIPS, many countries were able to adopt minimal standards of protection for intangible assets, thus creating an unprecedented degree of legislative harmonization for this field in a global scale. That said, for Brazilian law, TRIPS is a statute residing on the subconstitutional order, thus, it is the duty of the Superior Court of Justice (STJ) to uniformize the interpretation of the Agreement within the Brazilian Judiciary. Hence, this study aims to evaluate the evolution of the STJ’s stance on the TRIPS. This is a qualitative, quantitative, and exploratory research which utilizes the logical-deductive method and the procedures of literature review, collection and cataloguing of rulings by the STJ as a means of investigating the field. As a result, considerations are made into the main quantitative data gathered from the collection performed. Additionally, the prevailing stances of the Superior Court are identified and evaluated for changes over time.
