Abstract

O artigo discute a reforma da organização federal no Brasil, enfatizando a necessidade de uma administração pública que seja eficaz, eficiente e socialmente justa. Destaca a importância de compreender tanto as formas de organização quanto as relações interorgânicas e interadministrativas que influenciam as decisões administrativas. Salienta a distinção conceitual entre sujeito de direito e personalidade jurídica, ressaltando que, embora os órgãos não sejam considerados pessoas, podem possuir subjetividade organizatória e enfaixar direitos e obrigações em face da administração direta, conforme a legislação. Menciona precedentes judiciais que reconhecem direitos funcionais dos órgãos e faz referência a tentativas anteriores de reforma da organização administrativa durante o governo Lula II (2006-2009). A complexidade da organização administrativa brasileira é enfatizada, com a argumentação de que as relações organizativas são frequentemente subestimadas, resultando em insegurança jurídica e ineficiência. A necessidade de normas claras que definam competências e prerrogativas é destacada, a fim de evitar ambiguidades que possam comprometer a agilidade e a estabilidade das decisões administrativas. Por fim, é mencionada a criação de uma Comissão de Especialistas com o objetivo de revisar o Decreto Lei 200/1967, buscando modernizar a organização administrativa e promover uma gestão pública mais eficiente e transparente. The paper discusses the reform of the federal organization in Brazil, emphasizing the need for a public administration that is effective, efficient and socially just. It highlights the importance of understanding both the forms of organization and the inter-organizational and inter-administrative relationships that influence administrative decisions. It stresses the conceptual distinction between subjects of law and legal personality, pointing out that, although bodies are not considered persons, they can have organizational subjectivity and can have rights and obligations vis-à-vis the direct administration, depending on the legislation. It mentions judicial precedents that recognize the functional rights of bodies and refers to previous attempts to reform administrative organization during the Lula II government (2006-2009). The complexity of Brazilian administrative organization is emphasized, with the argument that organizational relationships are often underestimated, resulting in legal uncertainty and inefficiency. The need for clear rules that define competencies and prerogatives is highlighted, in order to avoid ambiguities that could compromise the agility and stability of administrative decisions. Finally, mention is made of the creation of a Commission of Experts with the aim of revising Decree Law 200/1967, seeking to modernize administrative organization and promote more efficient and transparent public management.
