DIREITO E AMPARO AOS ANIMAIS NÃO-HUMANOS: UMA PERSPECTIVA BIBLIOGRÁFICA A PARTIR DO DIREITO COMO SABER CIENTÍFICO

Abstract

RESUMO O objetivo desse artigo é analisar a visão que o ser humano tem estabelecido a respeito dos animais não humanos desde os tempos primórdios. Com isso, é possível oportunizar a reflexão crítica no que tange à natureza e à relevância do suporte ético sobre a qual se sustentam as nossas considerações sobre os animais e, com efeito, a forma de tratamento que é destinada a eles. O escopo é avaliar o ordenamento jurídico brasileiro, o direito dos animais e quais os fatores de inclusão para ser digno da comunidade moral. O recurso metodológico utilizado é a pesquisa bibliográfica realizada a partir de análise de obras e materiais já publicados na literatura bem como fontes divulgadas no meio eletrônico considerando a aproximação que se estabelece com o objeto de pesquisa em pauta.
