LOS LÍMITES A LOS MEDIOS PROBATORIOS DE OFICIO EN EL PROCESO CIVIL

Abstract

El sistema procesal civil peruano es un sistema mixto que ha recibido elaporte del dispositivismo, liberalismo o sistema privatístico y delinquisitivismo, intervencionismo o sistema publicístico, con una tendenciaactual a un mayor predominio del sistema publicístico. Aun en los sistemas procesales donde hay un predominio del principiodispositivo, la búsqueda de la verdad única, una vez determinados loshechos que deban de ser establecidos, es más que una justificación pararespetar la iniciativa del juez en la formación de las pruebas. Que, es de interés público la realización del derecho objetivo sobre la basede la verdad de los hechos; por ello, no puede existir una limitación total alas facultades del juez en materia probatoria. En la normatividad procesal civil peruana, corresponde al juez, en decisiónmotivada e inimpugnable, ordenar la actuación de medios probatorios deoficio cuando los ofrecidos por las partes sean insuficientes para formarconvicción. Siendo que la aportación de los hechos y la responsabilidad de probarlos esuna carga de la partes, la responsabilidad del juez, en relación a la carga dela prueba, sólo tiene cabida al existir hechos controvertidos respecto de loscuales resultan insuficientes los medios probatorios aportados por laspartes. El poder‑deber que tiene el juez para ordenar pruebas de oficio estálimitado a los hechos controvertidos que nacen de las posiciones de laspartes, a las fuentes de prueba aportadas por las mismas; y, a los límitesque imponen los principios de contradicción, igualdad de las partes eimparcialidad del juez como tercero en la relación procesal heterocompositiva.
