Método neutrosófico para evaluar el derecho a la resistencia desde la protesta social

Abstract

Un Estado Constitucional de Derechos, maneja el derecho a la resistencia y la protesta social dentro de su marco legal. Sin embargo, evaluar el derecho a la resistencia desde la protesta social constituye una tarea altamente sensible. La presente investigación tiene como objetivo desarrollar un método para evaluar el derecho a la resistencia desde la protesta social. La propuesta de método utiliza en su procesamiento un enfoque multicriterio mediante Delphi con números neutrosóficos. Se emplea un enfoque cualitativo y se utilizan varios métodos científicos, incluyendo el deductivo - inductivo, el analítico sintético, el análisis documental y el exegético jurídico, basándose en una investigación bibliográfica - documental, de campo y aplicada. Para recopilar datos, se realizó una entrevista semiestructurada a expertos en derecho constitucional. Los resultados principales revelaron que el derecho a la resistencia no está claramente definido en la Constitución, por el contrario, recae en ambigüedad y que la protesta social no está explícitamente reconocida como un derecho en ninguna normativa nacional o convencional.
