Abstract

O estudo sobre o dolo eventual, especificamente através da teoria do "levar a sério" (Ernstnahmetheorie) desenvolvida por Claus Roxin, oferece uma análise aprofundada da aplicação desse conceito no Direito Penal brasileiro. Esta teoria destaca-se por sua abordagem diferenciada na interpretação do dolo eventual, contrastando com outras teorias volitivas e da representação. O trabalho examina a definição legal de dolo no Código Penal Brasileiro, que adota a teoria da vontade ou do assentimento, e expõe as nuances entre dolo direto e dolo eventual. A teoria do "levar a sério" propõe dois níveis de análise: o intelectual, onde o agente prevê o resultado, e o emocional, onde aceita a possibilidade do resultado. A pesquisa utiliza metodologia bibliográfica para explorar decisões judiciais e concepções teóricas de renomados juristas. Conclui-se que a aplicação da teoria do "levar a sério" proporciona uma compreensão mais precisa do dolo eventual, diferenciando-o claramente da culpa consciente, e sublinha a importância da consideração do contexto emocional do agente na determinação da responsabilidade penal.
