Abstract

In the article approaches to resolving issues associated with the need of implementation including law, self-defense, without the lawyer's support, on social indicators, citizens of the United States of America, which in most cases determines the notorious loss of such persons in the judicial process, which in turn is due to legislative complexities and heterogeneity of the procedural rules of dispute resolution in different States, lack in defensive skills and experience of independent participation in the judicial process; the segmented data of the so-called «legal deserts maps», indicating the presence of experts in the field of justice, contributing to the provision of appropriate legal assistance. Also explores the comparative features of legal support of court cases involving animals on the basis of a comparison of the legal approaches developed in the middle ages in several European countries and in the United States; identified the main possible areas of harmonization of provisions of national legislation of the Russian Federation and legislation of the individual States of the United States on procedural issues in this area, in the framework of private international law. В статье выделены подходы к разрешению проблемных вопросов, связанных с необходимостью осуществления в том числе судебной, самозащиты, без адвокатской поддержки, по социальным показателям гражданами Соединенных Штатов Америки, что в большинстве случаев предопределяет заведомый проигрыш таких лиц в судебном процессе, что в свою очередь связано с законодательными сложностями и неоднородностью процессуальных правил разрешения споров в разных штатах США, отсутствием у защищающихся необходимых навыков и опыта самостоятельного участия в судебных процессах; приведены сегментированные данные так называемых «карт юридических пустынь», свидетельствующих о наличии специалистов в области судопроизводства, способствующих оказанию надлежащей юридической помощи. Также исследуются компаративные особенности правового обеспечения судебных дел с участием животных на основе сравнения правовых подходов, выработанных еще в средние века в ряде европейских государств и в США; определены основные возможные направления унификации норм национального законодательства Российской Федерации и законодательства отдельных штатов США по процедурным вопросам в указанной сфере, в рамках международного частного права.
