DIREITO TRANSNACIONAL E O TRANSJUDICIALISMO COMO INSTRUMENTO DE PROTEÇÃO AMBIENTAL

Abstract

Os danos ambientais gerados pelo modo de vida atual da sociedade, a par de fomentar discussão sobre limites que devem ser impostos a certas atividades humanas, também são causadores de embates entre diversas parcelas da sociedade. Nesse contexto, surge a constatação de que as ações lesivas ao meio ambiente, muitas vezes, ultrapassam o poder da coerção estatal, porquanto seus efeitos não se restringem aos limites territoriais dos países. Este fato, irrefutável, gera também questionamentos sobre a adequada resolução deste problema moderno. Deste modo, importante analisar o dano ambiental como uma das expressões da transnacionalidade, bem como investigar o transjudicialismo como instrumento eficaz para prevenir e punir os responsáveis por danos ambientais transnacionais. O objeto do trabalho é analisar o Direito Transnacional e o Transjudicialismo como instrumento de proteção ambiental. Foi utilizado o método indutivo e a pesquisa foi operacionalizada pelas técnicas do referente e da pesquisa bibliográfica. Como resultado, foi observado que o transjudicialismo tem potencial para ser eficaz no combate aos danos ambientais ao promover a harmonização de normas e a cooperação entre diferentes jurisdições.
