Abstract

Суд-тергов амалиётида иштирокчиликда содир этилган жиноятлар учун жавобгарликни белгилаш масаласида, жумладан, айрим холатларда жиноят конунчилигида назарда тутилган иштирокчилик турлари ва шаклларининг нотўғри талкин килиниши ёхуд терговчиларнинг дастлабки тергов давомида жиноятда иштирок этган шахслар килмишларини тўлик ёритиб бера олмаётганлигини , иштирокчиликнинг бажарувчи, ташкилотчи, далолатчи, ёрдамчи каби турлари ёки оддий, мураккаб, уюшган гурух ва жиноий уюшма шаклларининг зарурий белгиларини батафсил исботлаб бера олмаётганлиги суд жароёнида ушбу шахсларга нисбатан жавобгарликни белгилашда бир катор кийинчиликлар келиб чикишига сабаб бўлмокда.
