Розглядається правова природа поняття «безпека» як загального терміна в юриспруденції, так і в якості захисту держави щодо осіб, залучених до виконання завдань оперативно-розшукової діяльності під час негласного і конфіденційного співробітництва. Здійснено аналіз думок вчених, законодавства країн Європи і національних законодавчих актів, що дозволило визначити існуючі проблеми і напрямки вдосконалення правового регулювання організації використання негласного і конфіденційного співробітництва з іншими особами під час кримінального провадження. Рассматривается правовая природа понятия «безопасность» как общего термина в юриспруденции, так и в качестве защиты государства в отношении лиц, привлеченных к выполнению задач оперативно-розыскной деятельности во время негласного и конфиденциального сотрудничества. Осуществлен анализ мнений ученых, законодательства стран Европы и национальных законодательных актов, что позволило определить существующие проблемы и направления совершенствования правового регулирования организации использования негласного и конфиденциального сотрудничества с другими лицами во время уголовного производства. It is considered the legal nature of the concept of «safety» as a general term in jurisprudence, as well as the protection of the state in relation to persons involved in the execution of the tasks of operational and investigative activities during secret and confidential cooperation. In addition, the social and legal safeguards for the protection of operational units and other participants in operational activities are analyzed. Also, in the article there are investigated the reasons for the need to use operational and technical means in operational-search activities to ensure the rights and freedoms of the individual, the legitimate interests of citizens and the state. The problems of legal regulation of the use by investigators of confidential cooperation with other persons are determined. It is investigated the state of the legislative regulation of the use of investigators of confidential cooperation during criminal proceedings. The analysis of the opinions of scientists, the legislation of European countries and national legislation were performed, which made it possible to determine the existing problems and directions of improvement of the legal regulation of the organization of the use of secret and confidential cooperation with other persons during the criminal proceedings. In the article there are discussed the provisions, which allow us to conclude that ensuring the safety of persons involved in the accomplishment of the tasks of operative and investigative activities during secret and confidential cooperation is one of the main tasks and at the same time is an integral part of the integrated concept of «operative and prosecution of criminal proceedings». The improvement of the regulatory framework in this context will be facilitated by the implementation of the provisions of the Laws of Ukraine «On Operational Investigative Activity», «On State Protection of Court Employees and Law Enforcement Bodies» and «On Ensuring the Security of Persons Involved in Criminal Proceedings» to the Criminal Procedure Code of Ukraine in the form of a separate section entitled «Ensuring the security of persons involved in criminal proceedings, judges, court employees and law enforcement agencies».
