Wymogi kwalifikacyjne na maszynistę kolejowego – ocena nowelizacji

Abstract

Rail transport plays an important role in today’s world and is an important part of the common transport policy in Europe. In order to bring national legislation in line with EU and to bring the standards of Polish rail transport closer to those of EU countries, the Amendment Act 2021 was introduced, effective from 1 January 2023. One of the main objectives of this amendment was to implement the EU directive on train driver qualifications. This law also introduced a state examination for the position of train driver in order to ensure verifiability of competences and to increase the level of safety. Until now, one entity had been conducting the training and examination of train drivers, which was criticised for its lack of transparency. The new legislation envisages the power to grant train driver licences being concentrated in the hands of the state. The training of train drivers is carried out by training centres and the examination takes place before the President of the Railway Transport Office. The changes introduced by the amendment are aimed at raising the level of training, ensuring fair and transparent rules for the confirmation of qualifications and increasing the safety of rail traffic. The President of UTK supervises railway undertakings and conducts examinations of candidates for a train driver’s licence and certificate.

Transport kolejowy odgrywa istotną rolę w dzisiejszym świecie i stanowi ważny element wspólnej polityki transportowej w Europie. W celu dostosowania przepisów krajowych do unijnych oraz zbliżenia standardów polskiego transportu kolejowego do krajów UE została wprowadzona ustawa nowelizująca z 2021 r., obowiązująca od 1 stycznia 2023 r. Jednym z głównych celów tej nowelizacji było wdrożenie dyrektywy unijnej dotyczącej uprawnień maszynistów. Ustawa ta wprowadziła również państwowy egzamin na stanowisko maszynisty w celu zapewnienia sprawdzalności kompetencji i podniesienia poziomu bezpieczeństwa. Dotychczas jeden podmiot prowadził szkolenie i egzaminowanie maszynistów, co krytykowano ze względu na brak transparentności. Nowe przepisy przewidują skupienie decyzji o przyznaniu licencji maszynisty w rękach państwa. Szkolenie maszynistów jest realizowane przez ośrodki szkolenia, a egzamin odbywa się przed prezesem Urzędu Transportu Kolejowego. Zmiany wprowadzone przez nowelizację mają na celu podniesienie poziomu nauczania, zapewnienie uczciwych i przejrzystych zasad potwierdzania kwalifikacji oraz zwiększenie bezpieczeństwa ruchu kolejowego. Prezes UTK nadzoruje przewoźników i przeprowadza egzaminy dla kandydatów na licencję i świadectwo maszynisty.
