El estudio tiene como objetivo general analizar la actual tendencia jurisprudencial sobre la participación del agraviado en el proceso inmediato en el Perú. En lo que respecta a la metodología empleada, este estudio se caracteriza por su enfoque cuantitativo y su aplicación de un método hipotético-deductivo de naturaleza básico. Además, se clasifica como un estudio con un nivel explicativo y sigue un diseño de investigación no experimental de tipo transversal. En lo que respecta a la población de estudio, se encuentra conformado por 34 abogados especializados en Derecho Constitucional del distrito de Puno; a los cuales se aplicó un cuestionario (Escala Likert) para extracción de datos. Resultados: el 52,9% de los abogados señalan que la influencia del agraviado equilibra el poder de decisión y puede contribuir a una mayor equidad en la determinación de la pena, es decir, se requiere una mayor participación del agraviado en el proceso inmediato. Conclusión: en el contexto jurídico peruano se observa una tendencia jurisprudencial desfavorable que obstaculiza la activa participación del agraviado durante el proceso inmediato. Esta tendencia se caracteriza por ser un obstáculo que dificulta la participación activa del agraviado en el proceso inmediato. En otras palabras, el análisis revela que las decisiones judiciales y la interpretación legal en Perú están actuando de manera que limita o impide la plena involucración de la persona afectada en el proceso inmediato.

The general objective of the study is to analyze the current jurisprudential trend on the participation of the injured party in the immediate process in Peru. Regarding the methodology used, this study is characterized by its quantitative approach and its application of a hypothetico-deductive method of a basic nature. Furthermore, it is classified as a study with an explanatory level of and follows a non-experimental cross-sectional research design. Regarding the study population, it is made up of 34 lawyers specialized in Constitutional Law from the district of Puno; to which a questionnaire (Likert Scale) was applied for data extraction. Results: 52.9% of lawyers point out that the influence of the injured party balances the decision-making power and can contribute to greater equity in determining the sentence, that is, greater participation of the injured party in the immediate process is required. Conclusion: in the Peruvian legal context, an unfavorable jurisprudential trend is observed that hinders the active participation of the injured party during the immediate process. This tendency is characterized by being an obstacle that hinders the active participation of the injured party in the immediate process. In other words, the analysis reveals that judicial decisions and legal interpretation in Peru are acting in a way that limits or prevents the full involvement of the affected person in the immediate process.
