Abstract

Questo lavoro è stato presentato come dissertazione nel quadro di un post-dottorato in Nuove Tecnologie e Diritto presso l'Università degli Studi "Mediterranea" di Reggio Calabria esponendo sette casi di utilizzo di sistemi di intelligenza artificiale legati a situazioni di migrazione e al loro impatto sui diritti umani di migranti e rifugiati. I primi quattro casi sono volti a sostenere gli aiuti alimentari, il reinsediamento e l'integrazione economica dei rifugiati e dei migranti in generale, mentre i restanti tre sono volti a garantire la sicurezza delle frontiere nell'Unione Europea a causa della pessante situazione umanitaria generata -in gran parte sotto la sua stessa responsabilità- nel Mar Mediterraneo e nelle rotte migratorie internazionali. Le conclusioni evidenziando i significativi benefici generati e anche le sfide legate alla privacy dei dati nella protezione dei diritti umani, dei diritti dei rifugiati e delle decisioni sull'immigrazione. Vengono proposte risposte giuridiche innovative che tengono conto dell'umanesimo algoritmico e della trasparenza digitale. In inglese: This paper was presented as a dissertation within the framework of a post-doctoral fellowship in New Technologies and Law at the Università degli Studi 'Mediterranea' of Reggio Calabria, presenting seven cases of the use of artificial intelligence systems related to migration situations and their impact on the human rights of migrants and refugees. The first four cases are aimed at supporting food aid, resettlement and economic integration of refugees and migrants in general, while the remaining three are aimed at securing borders in the European Union due to the pressing humanitarian situation generated - largely under its own responsibility - in the Mediterranean Sea and international migration routes. Conclusions are drawn highlighting the significant benefits generated and also the challenges related to data privacy in the protection of human rights, refugee rights and migration decisions. Innovative legal responses are proposed that take into account algorithmic humanism and digital transparency.
