Abstract

La ambigüedad que ostentan los mecanismos de aplicación coercitiva del Derecho Internacional es utilizada por el gobierno de Estados Unidos para encubrir medidas de fuerza como parte de su política exterior. En el artículo se evalúan las diferencias doctrinales de la represalia, la contramedida, la retorsión y la sanción como principales mecanismos de aplicación coercitiva en la actualidad. En correspondencia, se examinan las disposiciones contenidas en la Ley para la Solidaridad Democrática y la Libertad Cubanas, conocida como Ley Helms Burton, que califican como medidas coercitivas unilaterales, violatorias de los principios de igualdad soberana, de no intervención y prohibición de la amenaza o el uso de la fuerza
