Abstract This subject revolvers round the problem of the right to exercise public liberties, especially the right to establish associations and political parties, and the restrictions imposed on exercising this right by authorities imposing strict control over the founding procedures, leading to disputes requiring legal intervention. Despite the Moroccan legislator granting associations and political parties the right to freely conduct their activities within the legal framework, setting conditions and procedures for their establishment, conflicts may arise between them and the authorities or among members and organizational leadership. These disputes manifest in various forms, such as failure to complete necessary documentation, lack of sufficient legal representation, or misuse of authority. Administrative positions often tend towards arbitrariness, either refusing to accept establishment files or withholding acknowledgment receipts. In such cases, the administrative judge intervenes to rebuke the administration’s decisions and stress compliance with the legal texts regulating this freedom, whether it involves forming an association or a political party. يتمحور هدا الموضوع حول إشكالية الحق في ممارسات الحريات العامة خاصة الحق في تأسيس الجمعيات و الأحزاب السياسية ، والتضييق على ممارسة هدا الحق من طرف السلطة التي تفرض مراقبة صارمة على مساطر التأسيس وما يترتب عن دلك من منازعات تتطلب تدخل القاضي الإدا ري . فعلى الرغم من أن المشرع المغربي خول للجمعيات والأحزاب السياسية حق ممارسة أنشطتها بكل حرية في إطار القانون، وحدد شروط وإجراءات تأسيسها، فقد تظهر في الأفق منازعات بينها وبين السلطة من جهة أو بين الأعضاء والقيادات التنظيمية لهاته الهيآت من جهة أخرى. وهذه المنازعات تتخذ صورا ومظاهر متعددة، فقد تكون على مستوى الإخلال بمسطرة التأسيس كعدم استكمال الوثائق اللازمة، أو عدم احترام النصاب القانوني الكافي أو انعدام الأهلية القانونية للتقاضي، أو قد تكون لعيب الانحراف في استعمال السلطة. الكلمات المفاتيح:الحريات العامة، النظام التصريحي، النظام الترخيصي، وصل ايداع، المجتمع المدني.
