الإطار المفاهيمىِ للعقود الذكية

Abstract

ظهر نمط تعاقدىِ جديد يُعرف بالعقود الذكية، باتت واقعاً معاشاً فىِ العديد من الدول، لذا كان على المشرع تنظيم هذا النمط التعاقدىِ الجديد، ولاسيما أن هذه العقود من المتوقع أن يزيد الطلب عليها مع انتشار وتطور انترنت الأشياء, فهى ذات سمات خاصة ومميزة تجعل من تطبيقها أكثر أمناً، والعقود الذكية هى تقنية مبنية باستخدام البلوك تشين، تستطيع من خلالها أن تنشئ عقدًا قانونيًا أتوماتيكى التنفيذ محفوظ فىِ سلسلة الكتل، بحيث تجعل العمليات أسرع وأكثر شفافية، وغير قابلة للتزوير، ولا رجعةَ فيها, ولا يتطلب وجود سلطة مركزية. ومن خلال هذه الورقة البحثية سنتناول كل ما يتعلق بالعقود الذكية من خلال تعريفه وبيان أهم سماته, ومتى ظهر, وحدوده, واستخداماته, وفوائده.
