Especialidades procesales como medidas de contraterrorismo

Abstract

La lucha antiterrorista se ha convertido en uno de los principales desafíos del mundo actual. Tal lucha se viene articulando a través de dos tipos de medidas: antiterroristas y contraterroristas. La evolución del Derecho Penal y del Derecho Procesal ha supuesto una merma en los derechos fundamentales de los ciudadanos, en aras, precisamente, de erradicar el terror. Se analizan más en concreto las especialidades procesales que, como medidas contraterroristas, han supuesto un recorte en las garantías procesales de los justiciables. Por último se reflexiona sobre si es posible alcanzar el equilibrio entre los dos bienes jurídicos a salvaguardar: libertad y seguridad.

The fight against terrorism has become one of the main challenges in the world nowadays. This fight has been articulated through two types of measures: anti-terrorism and counter-terrorism. The evolution of Criminal Law and Procedural Law has led to a reduction in the fundamental rights of citizens, precisely for the sake of eradicating terror. The procedural specialties that, as counter-terrorism measures, have meant a reduction in the procedural guarantees of the defendants, are analyzed more specifically. Finally, it is reflected on whether it is possible to achieve a balance between the two legal rights to safeguard: freedom and security.
