Abstract

El marco normativo que rodea la admisibilidad y práctica de la declaración de un niño cuando es sospechoso, acusado, víctima o testigo en el proceso penal es un tema de actual importancia porque, desafortunadamente, los menores participan en la comisión de delitos y son víctimas y testigos de ellos, no solo dentro de las fronteras de los Estados sino también trascendiéndolas. Este trabajo inicia su recorrido ofreciendo un análisis de la manera de tratar a los niños y su testimonio por parte de la administración de justicia a lo largo de la historia. Tras este análisis, se adentra en la coerción, las garantías que aseguran una participación efectiva, los límites al principio de contradicción y por último el requisito de la corroboración como piedras angulares del derecho internacional de los derechos humanos aplicable a la admisibilidad y práctica de la declaración de un menor en el proceso penal. A través del estudio de los lugares en que las normas se entrecruzan, se plantean numerosos interrogantes, se evidencian lagunas, vacíos y contradicciones que pueden provocar que los niños caigan dentro de esos huecos, provocando una desprotección, o una discriminación injustificada en su contra. Ofreciendo un análisis sistemático de la normativa y de la jurisprudencia que modula el alcance de los derechos, este trabajo puede ser de utilidad para todos aquéllos operadores jurídicos y profesionales que busquen proteger y defender los derechos de los niños y niñas en el proceso penal. The regulatory framework surrounding the admissibility of a child's statement when he or she is a suspect, accused, victim or witness in criminal proceedings is an issue of current importance because, unfortunately, children participate in the commission of crimes and are victims and witnesses of them, not only within the borders of the State but also beyond them. This work begins its journey by offering an analysis of the way children are treated and their testimony throughout history. After this analysis, it delves into coercion, the guarantees that ensure effective participation, the limits to confrontation and finally the requirement of corroboration as cornerstones of international human rights law applicable to the admissibility of a child's statement in criminal proceedings. Through the study of norm intersection, numerous questions are raised, gaps and contradictions arise that can cause children to fall into these gaps, causing a lack of protection, or unjustified discrimination against them. Offering a systematic analysis of the regulations and jurisprudence that modulate the scope of international human rights law that applies to this area of research, this work can be useful for all those legal operators and professionals who seek to protect and defend the rights of children in criminal proceedings.
