Retos y perspectivas en la investigación biomédica con datos en España

Abstract

El objetivo principal de esta contribución es identificar los retos y perspectivas que presenta la investigación biomédica con datos en España, realizando una breve aproximación al marco jurídico actual, atendiendo en particular los biobancos; y con un enfoque jurídico multinivel, es decir, teniendo en cuenta la regulación no solo interna sino también europea, para poder identificar algunas de las carencias que presenta el actual marco normativo. El avance de los biobancos y la tecnología de investigación en la actualidad está mejorando la efectividad de la investigación científica biomédica, gracias al uso masivo de datos. Sin embargo, al mismo tiempo, esta investigación enfrenta dilemas éticos y legales en la búsqueda de un equilibro con otros derechos, en especial aquellos vinculados a la esfera de la privacidad de la persona, lo que hace esencial conocer el marco jurídico aplicable.

The main objective of this contribution is to identify the challenges and perspectives presented by biomedical research with data in Spain, making a brief approach to the current legal framework, with a particular attention to biobanks; and with a multilevel legal approach, that is, taking into account not only internal but also European regulation, in order to identify some of the shortcomings of the current regulatory framework. The advancement of biobanks and research technology is currently improving the effectiveness of biomedical scientific research, thanks to the massive use of data. However, at the same time, this research faces ethical and legal dilemmas looking for a balance with other rights, especially those linked to the sphere of privacy of the person, which points OUT the relevance of knowing the applicable legal framework.
