In the present article was carried out a research of judicial practice and the procedural-criminal norms regarding attributing the quality of successor of the deceased victim to the surviving spouse. The presented problem consists in the scientific substantiation and practical regarding of the way of applying in the legal provisions, which is not currently expressly provided for in art. 81 of the Criminal procedure code of the Republic of Moldova, as well as the analysis of the legislation, resulting in the substantiation of rigorous proposals in order to improve the legislation and jurisprudence. Through this study, we want to provoke further analysis and discussion on this topic.
