L'articulation entre les régimes de Zones Franches d'Exportation et le Droit International de l'Investissement

Abstract

Les zones franches d'exportation (ZFE) constituent des territoires délimités soumis à des régimes spécifiques. Elles se veulent désormais une politique indispensable de développement, compte tenu de leur rôle indéniable dans l'attrait des Investissements Directs Étrangers (IDE) et la promotion des exportations. Ainsi, la contribution desdites zones à l'envolée des mouvements des IDE implique une nette interaction entre ces régimes dérogatoires et les règles internationales régissant les flux des IDE, en l'occurrence le Droit International de l'Investissement (DII). Malgré la standardisation des régimes nationaux des ZFE et leur ressemblance quant aux principales catégories d'incitations accordées, chaque régime se distingue par son contenu normatif, voire promotionnel. En effet, la multiplication impressionnante de ces régimes préférentiels profile une nouvelle forme d'unilatéralisme dont l'apport normatif au DII – tant marqué par le règne du bilatéralisme – ainsi que les interdépendances qui en résultent, méritent d'être examinées. L'objectif de cet article est donc de mettre en évidence le nexus entre les régimes des ZFE en tant qu'actes unilatéralement établis et les règles de promotion et de protection des investissements directs étrangers.
