La falta de legitimidad y la erosión democrática en las reformas al artículo 27 constitucional

Abstract

El objetivo de este trabajo es identificar si las reformas que se hicieron al artículo 27 de la Constitución Política de los Estados Unidos Mexicanos –acaecidas en 1992– las cuales modificaron sustancialmente el sistema jurídico agrario en México, pueden ser señaladas como ilegítimas y antidemocráticas, bajo la perspectiva de la "erosión democrática" de Roberto Gargarella. Al analizar desde un enfoque filosófico-epistémico la legitimidad de las constituciones y la erosión democrática presente en los cambios al paradigma agrario vigente. Siendo la hipótesis planteada que estas modificaciones al texto constitucional sí fueron ilegítimas y antidemocráticas toda vez que dichos cambios fueron realizados por las élites del país sin tomar en cuenta a las personas directamente involucradas, como lo son los campesinos, indígenas y ejidatarios del país.
