Agreement on out-of-court compensation for suffering

Abstract

This article considers a number of topical issues related to the agreement on voluntary compensation for suffering between the victim and the offender. These issues are considered on the basis of judicial practice in this area, in particular, the resolution of the Plenum of the Supreme Court of the Russian Federation No. 33 "On the practice of application by courts of norms on compensation for moral damage" dated November 15, 2022. It is concluded that there is a lack of necessary and sufficient uniformity in judicial practice in approaches to the agreement on non-judicial voluntary compensation for suffering, which does not contribute to the timely settlement of offenders' relations with victims on this issue.
