O presente trabalho trata do surgimento e evolução do Estado Constitucional de Direito. Discute o fato his- tórico em contexto sucinto, contrapondo os conceitos de Estado de Direito, Estado Legal e Estado de Direito Cons- titucional. Foi concebido originalmente como monografia para atender à disciplina Teoria Geral do Constituição minis- trada pelo Professor Titular André Ramos Tavares, no Curso de Doutorado em Direito da Pontifícia Universida- de Católica de São Paulo, no ano de 2005.
