Abstract

According to rough estimates, the volume of transactions of citizens of the Russian Federation with cryptocurrencies reaches 350 billion rubles per year, since cryptocurrencies are in second place in terms of the frequency of making the first purchase after shares – 11% and 28%, respectively. The Russian Federation as a whole has reached the third place in terms of bitcoin mining in the world – 11.25% of all the world's computing power used for mining falls on Russia. Given this, cryptocurrencies are increasingly appearing in bankruptcy cases. In this article, we will analyze legislative regulation and judicial practice in relation to cryptocurrencies in the prism of bankruptcy of debtors of citizens – owners of cryptocurrencies, and also outline the practical difficulties that arise when working with cryptocurrency in bankruptcy cases.

По приблизительным оценкам, объём операций граждан Российской Федерации с криптовалютами достигает 350 млрд. руб. в год, так как криптовалюты находятся на втором месте по частоте совершения первой покупки после акций – 11% и 28% соответственно. Российская Федерация в целом вышла на третье место по объёму майнинга биткойна в мире – 11,25 % всех мировых вычислительных мощностей, используемых для майнинга приходятся на Россию. Учитывая это, криптовалюты всё чаще фигурируют в делах о банкротстве. В настоящей статье проанализируем законодательное регулирование и судебную практику в отношении криптовалют в призме банкротства должников граждан – владельцев криптовалют, а также обозначим практические сложности, возникающие при работе с криптовалютой в банкротных делах.
