Abstract

Dans le conflit israélo-palestinien, se conjuguent visiblement deux points de vue. L'un abstrait, défini et reconnu dans le droit commun aux Nations, notamment à travers la Cour pénale internationale (CPI) qui déclare l'État de Palestine souverain sur son territoire comprenant la Cisjordanie, la Bande de Gaza et Jérusalem-est néanmoins sous occupation belligérante ; l'autre point de vue plus concret sur le terrain, s'alimente des failles utopiques des systèmes internationaux en maintenant la vision ségrégationniste d'un seul État politique dominant du fleuve à la mer. Dès lors, toute forme de domination est conditionnée au droit universel de résistance à l'oppression. Autant le droit du peuple palestinien à l'autodétermination est résolument acquis, autant l'ingérence politique des gouvernements occidentaux dans le conflit israélo-palestinien conditionne leurs propres sociétés à la désobéissance civile en appel au fondement de l'article 28 de la Déclaration universelle des droits de l'homme des Nations Unies. – Article 28 – « Toute personne a droit à ce que règne, sur le plan social et sur le plan international, un ordre tel que les droits et libertés énoncés dans la présente Déclaration puissent y trouver plein effet ».
