AMPARO EN REVISIÓN 100/2021. PROCEDIMIENTO ABREVIADO COMO FACULTAD EXCLUSIVA DEL MINISTERIO PÚBLICO.

Abstract

La importancia de la sentencia del amparo en revisión 100/2021[1] formulada por la Primera Sala de la Suprema Corte de Justicia de la Nación radica en que se cuestiona la regularidad constitucional del procedimiento abreviado, en cuanto a los requisitos, oportunidad y trámite, fundado en los artículos 201 fracción I, 202 párrafo primero y 205 párrafo primero, todos del Código Nacional de Procedimientos Penales. El objetivo del presente ensayo es hacer un análisis de la sentencia, comenzando con algunos antecedentes, continuando con el análisis de las cuestiones sobresalientes, de los argumentos que presenta la sentencia y del como derivaron los puntos resolutivos. Por último, a manera de conclusión, expondré los puntos relevantes y el impacto de esta resolución. [1] Amparo en Revisión 100/2021. Primera Sala.
