LA LINGUISTIQUE JURIDIQUE: LES INTERACTIONS DU LANGAGE ET DU DROIT

Abstract

La linguistique juridique a pour objet les interactions du langage et du droit : l'action du droit sur le langage et l'action du langage sur le dro-it. On pourrait également dire qu' il s' agit de deux superstructures (le droit et la langue) qui s' influencent mutuellement. Si l'on s'arrête plus particulièrement sur la terminologie juridique, quel que soit le corpus étudié, on peut remarquer qu'elle comporte plusieurs spécificités par rap-port au langage courant. Certains termes ont une double appartenan-ce. D'autres termes appartiennent exclusivement à la langue juridique. Le langage du droit, comme toute LS, est constitué de quatre éléments premiers: une sémantique, une syntaxe, un lexique et une stylistique. En pénétrant dans la sphère du droit, le mot usuel subit une inflexion, parfois même une mutation qui lui confère la précision technique, fac-teur nécessaire de la sécurité juridique, mais l'isole et le rend peu à peu incompréhensible au non spécialiste.
