
This study examines the highest land disputes or conflicts. Law No 39 of 2014 concerning Plantations in conjunction with Law No. 11 of 2020 concerning Job Creation, hereinafter referred to as the Plantations Law on a certain scale requiring a plantation business permit has developed after the reform period. The research method used is normative juridical research method. The research results show the highest land dispute or conflict is in the plantation sector. There is a problem in Law No. 39 of 2014 concerning Plantations. Strengthening the legal position stated in the law and its psychological impact where plantation business actors (companies) can control plantation land according to permits on customary law community, customary land rights. Balance as a principle in managing plantation business is very important in realizing the values of justice and courage. Balance as a principle in managing plantations is in accordance with the basic values in Pancasila and the 1945 Constitution of the Republic of Indonesia. Balance through the position of plantation business actors (companies) with customary law community has the same position of fulfilling rights and obligations.
