
The aim of this paper is to describe the purpose and the character of the municipality as two elements shaping the adequate perspective for the analysis of the legal grounds on which municipalities can perform municipal activities in the form of commercial companies. The purpose is not to conduct an analysis of the relevant provisions of law regarding the participation of municipalities in the private-law sphere but to characterise the matters of the highest importance for such analysis.
