
This article explores the foundations of copyright protection and the relationship between, on the one hand human rights and fundamental rights from the EU perspective and, on the other, copyright. The main question for this essay, is whether we should include the discussion on fundamental rights, in the discussion on the intellectual property rights, with the example of copyright. As the answer to this question, is in the Author's opinion positive, the article further explores what is the impact of this discussion on the current shape of EU copyright law, and problems of implementation of the Directive on Copyright in the Digital Single Market ( UE) 2019/790.
