El impacto de las potestades urbanísticas del Estado en el sector inmobiliario y su repercusión sobre los derechos fundamentales

Abstract

En el presente artículo, el autor realiza un estudio sobre la demora o lentitud de los procedimientos para el otorgamiento de licencias de habilitaciones urbanas y edificaciones, que se debe, principalmente, al desconocimiento de la normativa aplicable y/o al ejercicio arbitrario o deficiente de los funcionarios de las municipalidades, que a su vez se traduce en la exigencia de mayores requisitos de los contemplados en el marco normativo nacional, creación de nuevos procedimientos administrativos, entre otros.La demora de dichos procedimientos no solo afecta a los proyectos inmobiliarios, sino también impacta en las actividades y servicios complementarios necesarios para su ejecución, tales como el diseño, elaboración y ejecución de los proyectos, la supervisión de las obras, la contratación y el inicio de labores de los contratistas, los proveedores de insumos y servicios, los administradores y trabajadores, los adquirentes de unidades inmobiliarias, entre otros servicios y actividades que contribuyen a la economía del país; así como la afectación a libertades patrimoniales y derechos fundamentales reconocidos.
