El ‘derecho a la ciudad’ y su reconocimiento dentro del ordenamiento jurídico peruano

Abstract

El presente artículo busca evidenciar la importancia de la introducción del concepto y los componentes del derecho a la ciudad en la legislación peruana. Para ello, se toma en cuenta el creciente reconocimiento de la importancia de las ciudades en la ‘Nueva Agenda Urbana’ y la búsqueda de asegurar una calidad de vida adecuada a los habitantes de una ciudad.  Asimismo, los autores plantean la superación de la concepción de la ciudad como un espacio físico en donde únicamente se busca producir riquezas y beneficios individuales, en favor del reconocimiento de la ciudad como espacio de interacción y desarrollo de los ciudadanos en colectividad. A partir de esta concepción, el derecho a la ciudad se identifica como un principio rector que busca generar espacios de participación colectiva, un adecuado reparto de beneficios y cargas urbanísticas, y promover el desarrollo de una ciudadanía activa.
