Abstract

Las nuevas tecnologías de la información en los últimos tiempos han tenido una exponencial inmersión en el ámbito del Derecho, principalmente en el campo Penal, contexto propiciado por el inminente auge de la globalización en todo el mundo, fenómeno que ineludiblemente permeo a Colombia trayendo consigo un nuevo reto jurídico -social que obligó la expedición de la ley 1273 de 2009, norma que buscó la protección e integridad de los datos informáticos y el afrontamiento de los desafíos y particularidades de este nuevo paradigma delictivo en nuestro país, aun así, se presentan problemas de tipificación y aplicación que se manifiestan en el delito de interceptación de datos informáticos contemplado en el artículo 269C del Código Penal Colombiano, ya que este tipo penal deja varios interrogantes al determinar los alcances que tiene el sujeto activo para incurrir en el delito con la expresión “sin orden judicial previa”, situación que la Corte Constitucional aclara, manifestando no solo la necesidad de obtener orden judicial previa, sino además la de carácter posterior para no incurrir en su comisión.

The new information technologies in recent times have had an exponential immersion in the field of law, mainly in the criminal field, a context propitiated by the imminent rise of globalization worldwide, a phenomenon that inevitably permeated Colombia bringing with it a new legal-social challenge that forced the issuance of Law 1273 of 2009, a rule that sought the protection and integrity of computer data and the confrontation of the challenges and peculiarities of this new criminal paradigm in our country, even so, there are problems of typification and application that are manifested in the crime of interception of computer data contemplated in article 269C of the Colombian Penal Code, since this criminal type leaves several questions when determining the scope that the active subject has to incur in the crime with the expression "without prior judicial order", a situation that the Constitutional Court clarifies, stating not only the need to obtain prior judicial order, but also the subsequent one in order not to incur in its commission.
