Abstract

O direito humano-fundamental de acesso à justiça, que é efetivado por meio de serviço público, foi impactado pela pandemia da Covid-19. No Brasil, o TRF-3, que é um dos órgãos judiciais com maior concentração de processos, pois abrange os Estados de São Paulo e Mato Grosso do Sul, iniciou, em 2013, a sua virtualização por meio da implementação do processo judicial eletrônico. Nesse contexto, esta pesquisa teve como objetivo compreender o desempenho do TRF-3 no acesso à justiça por meio do PJe na pandemia da Covid-19. Para tanto, realizou-se estudo de caso em diferentes fontes, com destaque para os dados coletados no site da Justiça Federal de 2014 a 2020 sobre as sentenças prolatadas pelo TRF-3. Como resultados, verificou-se que o TRF-3, em 2019, já possuía um grau de virtualização de 80%, o que possibilitou o seu funcionamento de forma remota durante a pandemia da Covid-19. Inclusive, o referido Tribunal, em 2020, época mais crítica da pandemia, apresentou um aumento de 5% na prolação de sentenças em comparação a 2019. Também, o TRF-3 adotou outras medidas para a ampliação do seu atendimento remoto, como o balcão virtual, o Juízo 100% digital, as audiências telepresenciais e o uso de plataformas.
