Abstract

Esse artigo apresenta uma análise histórica do Estatuto da Cidade (EC), ancorada em estudiosos do tema, para questionar e abrir o debate sobre a efetividade dos instrumentos urbanísticos, argumentando sobre as expectativas construídas ao redor do mesmo e a contradição promovida na prática. Acredita-se que é importante apresentar algumas considerações e análises sobre as distintas fases do EC no Brasil, que estão expressas da seguinte forma: i) O resultado histórico da fragmentada e consolidada urbanização brasileira; ii) a esperança da Lei Federal 10.257/2001; e iii) a incorporação do mercado sobre o valor do solo urbano nos grandes centros urbanos brasileiros. Com algumas exemplificações sobre esse processo em Salvador (BA), e de uma observação de caso, busca-se debater essas distintas fases e compreender as reais dimensões sobre a execução dos instrumentos do EC, e como os mesmos se tornam indutores do processo de consolidação da pobreza e segregação socioespacial. This article presents a historical analysis of the City Statute (EC), anchored in scholars of the theme to question and open the debate on the effectiveness of urban planning instruments, arguing about the expectations built around it and the contradiction promoted in practice. It is believed that it is important to present some considerations and analyzes on the different phases of EC, which are expressed as follows: i) The historical result of the fragmented and consolidated Brazilian urbanization; ii) the hope of Federal Law 10.257/2001; and iii) an incorporation of the market on the value of urban land in large Brazilian urban centers. With some examples about this process in Salvador(BA), and a case observation, we seek to debate these different phases and understand the real ones about the implementation of EC instruments, and how they became inducers in the process of consolidation of the EC. poverty and socio-spatial segregation.
