Some Aspects of Public Service Reforming by Example of the Service Proceedings Supports of Judges of the Patronity Service (in the Light of the Updated Ukrainian Government Service Law and the Code of Administrative Proceedings of Ukraine)

Abstract

The article considers separate issues of priority directions of Ukraine, in particular: reforming the system of state administration, reforming the government service, carrying out administrative reform. Some aspects of the legal regulation of public service in Ukraine are outlined. The analysis of the term "public service" with the first step of its definition in the study of Ukrainian Scientist Y. Panek with further definition of the concept of "public service" at the legislative level, enshrined in The Code of Administrative Proceedings of Ukraine, is conducted. Consequently, Ukrainian scientist Y. Panayko considered the notion of "public service" by defining the concept of the state as a "corporation of public services" with subsequent change in accordance with the needs of "general interest". In turn, at the legislative level, the public service is defined as the activity of persons who are in state political positions, in state collegiate bodies, on positions of judges, prosecutors, military service or alternative (non-military) service, other civil service, patronage service in state agencies, service in the authorities of the Autonomous Republic of Crimea, local self-government bodies. It is emphasized that effective functioning of public service agencies is impossible without the existence of politically neutral and professional public servants. In the presented study, attention is paid to a specific category of public servants - assistants to judges. The circle of problematic issues of the institution of patronage service in judicial bodies related to the appointment of an additional assistant to a judge of the relevant court for the period of execution by the judge of administrative powers (duties of a member of the judge of the Council of Judges of Ukraine) is determined. Constructive ways of solving some issues, which were left out of the attention of the authors of the Regulations on the Assistant Judge (decision of the Council of Judges of Ukraine dated May 18, 2018, No. 21) regarding the appointment of an additional assistant judge of the relevant court for the period of execution by the judge of the administrative powers or duties of the judge- member of the Council of Judges of Ukraine, is suggested.
