Abstract

El presente artículo se centra en analizar la relación entre, por un lado, el desconocimiento y la recaracterización de operaciones entre partes vinculadas en aplicación del principio de libre concurrencia y, por el otro, las cláusulas antiabuso generales reguladas en nuestra normativa interna. El Tribunal Supremo ha tenido ocasión de pronunciarse sobre la ignorancia o recaracterización de transacciones entre partes vinculadas en aplicación del principio de libre concurrencia en dos sentencias. Si bien parte de la doctrina apreció un cambio jurisprudencial en la última de ellas, el presente artículo hace una lectura del fallo compatible con la línea jurisprudencial anterior, al entender que el Tribunal Supremo niega la posibilidad de ignorar o recaracterizar transacciones a las que cabe atribuir un valor de mercado, al incumplirse uno de los requisitos exigidos por las Directrices de Precios de Transferencia, a saber, la imposibilidad de asignar una retribución de mercado a la transacción.
