El presente trabajo pretende abordar el instituto de la prisión preventiva desde una perspectiva diversa a la usual. Para ello, luego de un repaso sobre algunos conceptos teóricos básicos y ciertos problemas prácticos que han distorsionado el uso racional de la detención cautelar, se abordará un tipo penal específico, en donde se advierte una particular convergencia de las disfuncionalidades constatadas: el delito de narcotráfico. A partir de esta figura, se analizará cómo, en el ordenamiento jurídico costarricense, en ausencia de estándares probatorios claros, se presenta una sustantivización de la prisión preventiva y un palpable automatismo, lo que puede reñir con principios estructurales de un sistema procesal propio de un Estado de Derecho
The present work pretends to approach the institute of bail denial from a different perspective the usual one. For this, after a review of some basic theoretical concepts and certain practical problems that have distorted the rational use of preventive detention, a specific criminal type will be examined, which reveals a particular convergence of the observed dysfunctions: the crime of drug trafficking. From this figure, it will be analyzed how, in the Costa Rican legal system, in the absence of clear standard of proof, there is a substantiation of pretrial detention and a palpable automatism, which may conflict with structural principles of a procedural system proper to a Rule of Law
