Abstract

[eng] The completion of the epistemological and normative study of crimes against humanity that definze the context of macrocriminality in the legal framework for transitional justice within the scope of the Justice and Peace from the criminal policy of prioritization , differential focus and lowering of substantive and procedural rights and guarantees, established that the model of transitional justice in the way it was conceived in the Law of Justice and Peace does not constitute a real transition from one stage of war to a state of peace, but follows a policy of betrayal, repentance and submission to justice, which contravenes the very principles of criminal law. The distortion, misunderstandings and the irrationalities of the most serious crimes committed in Colombia regarding the armed conflict and the need to build macrocriminality patterns, such as criminal policy of transitional justice, are far from complying with the principles of truth , justice, reparation and guarantees of non-repetition to achieve peace. The new special court for Peace that is coming as a result of the signing of agreements in Havana with the Revolutionary Armed Forces of Colombia FARC-EP, has laudable aims, but serious inconsistencies in the application of the principles of truth, justice, reparation and non-repetition of transitional justice and simultaneously, the nature of payment as a form of "no impunity" as a minimum requirement; it cannot meet if they continue to impose criteria of irrationality in the application of justice to avoid the guarantee of substantive and procedural rights, as is happening with the application of Law 975 of 2005, and continue to worship theories in which the exceptionality of rights and restrictions are reversed and become the general rule.

[spa] El modelo de justicia transicional en la forma como fue concebido en la Ley de Justicia y Paz no configura una verdadera transición de un estadio de guerra a un estadio de paz, sino que obedece a una política de delación, arrepentimiento y sometimiento a la justicia, que contraviene los principios mismos del Derecho penal. La distorsión, las incomprensiones y las irracionalidades sobre los crímenes de mayor gravedad cometidos en Colombia en torno al conflicto armado, y la exigencia de construcción de patrones de macrocriminalidad, como política criminal de la justicia transicional, distan mucho de dar cumplimiento a los principios de verdad, justicia, reparación y garantía de no repetición para el logro de la paz. La nueva Jurisdicción Especial para la Paz, que se avecina como consecuencia de la firma de los acuerdos en La Habana con las Fuerzas Armadas Revolucionarias de Colombia FARC-EP, tiene fines muy loables, pero serias contradicciones en la aplicación de los principios de verdad, justicia, reparación y no repetición de la justicia transicional y simultáneamente, el carácter de retribución como forma de no impunidad como exigencia mínima, que no se podrán cumplir si en la aplicación de la justicia se siguen imponiendo criterios de irracionalidad para evitar la garantía de los derechos sustanciales y procesales, como está sucediendo con la aplicacion de la Ley 975 de 2005, pues se sigue rindiendo culto a las teorías según las cuales se invierten las excepcionalidades de los derechos y sus restricciones se convierten en la regla general.
