En la presente Crónica de jurisprudencia se analizan tres cuestiones relevantes. En primer lugar, si es posible extinguir el contrato de trabajo vía artículo 50 del Estatuto de los Trabajadores por no haberse realizado una evaluación de su salud tras una baja por ansiedad motivada por causas laborales; en segundo lugar, la relevancia del concepto de ajuste razonable y el principio de no discriminación en relación con la discapacidad y, en tercer lugar, la equiparación del derecho de crédito horario entre los delegados de prevención y el resto de representantes de los trabajadores.
In this Chronicle of jurisprudence three relevant questions are analyzed. Firstly, if it is possible to terminate the employment contract via article 50 of the Workers Statute for not having carried out a health evaluation after a leave due to anxiety due to work‐related reasons; secondly, the relevance of the concept of reasonable adjustment and the principle of non‐discrimination in relation to disability and, thirdly, the equalization of the right to hourly credit between prevention delegates and the rest of the workers representatives.
